BILETA Response to Digital Regulation Cooperation Forum Call for Input – Consumer Interest and AI

This document constitutes the formal response of the British and Irish Law, Education and Technology Association (BILETA) to the Digital Regulation Cooperation Forum (DRCF) Call for Input on “Consumer Interest and AI”. Formulated by an expert panel of technology law scholars, this submission addresses the complex intersection of artificial intelligence, consumer protection, and cross-sectoral digital regulation in the UK. The response evaluates consumer attitudes, risk tolerance, and exposure to potential harms arising from the rapid adoption of generative and agentic AI systems. It critically analyzes the efficacy of proposed regulatory levers—such as informed consent, transparency disclosures, and the right to opt-out—while emphasizing the critical need for clear accountability and accessible redress mechanisms when AI causes harm. By offering evidence-based legal and policy recommendations, BILETA seeks to assist policymakers and regulators in developing proportionate, outcomes-focused frameworks that robustly safeguard consumer rights without unduly stifling technological innovation and economic growth.
