Abstract

This submission represents the British and Irish Law Education Technology Association's (BILETA) response to Ofcom's consultation on protecting people from illegal online harms. BILETA, as an organization committed to advancing research and education in technology law and policy, offers its expertise on the proposed regulatory framework. This response focuses on the complex interplay between safeguarding individuals online and upholding fundamental rights, particularly freedom of expression and access to information. We examine the proposed measures for addressing illegal content, emphasizing the need for clarity in definitions, proportionality in enforcement, and robust safeguards against overreach. BILETA highlights the importance of considering the impact on educational platforms and research institutions, advocating for a nuanced approach that balances public safety with the preservation of academic discourse and innovation. We address the challenges of content moderation, algorithmic transparency, and the potential for unintended consequences, urging Ofcom to adopt a framework that is both effective and respectful of digital rights. This submission provides detailed recommendations on the implementation of the proposed regulations, aiming to contribute to a balanced and effective online safety regime.
